Terms of use
Version of 31 October 2026
These terms govern the use of Vivat by organisers, who create events in the cabinet, and by participants, who open the app with a personal code.
1.Agreement
The Service is provided by [OPERATOR: legal name], [ADDRESS] (“we”). By creating an event or entering a code you accept these terms and the privacy policy. If you do not accept them, do not use the Service.
2.The Service
Vivat consists of a web cabinet for organisers and an app for participants (iOS, Android and a web version). It covers the event home screen, the programme and the run-of-show, push reminders, interactive modules such as guest bingo, and a shared photo gallery. Features may change; some of them are paid.
3.Accounts and codes
- An organiser signs in to the cabinet with an email address and keeps that access to themselves.
- Every participant gets a personal code. The code is an access key to the event: do not pass it on. The organiser can reissue a code; the old one then stops working.
- We limit attempts to enter a code and may block access that looks like guessing.
4.The organiser’s responsibilities
- to enter only the participants’ data they have a right to enter, and to tell the participants that the event uses Vivat, with a link to the privacy policy;
- to look after the event’s content: hide facts and photos that do not belong there;
- to use the Service lawfully and only for private and corporate events.
5.Content of participants
Participants upload photos and write facts about themselves. They keep their rights to this content and allow the organiser and the other participants of the same event to view it, and the organiser to download it, for as long as it is stored. We use the content only to store it and show it within the event.
- Do not upload anything unlawful, offensive or anything that you have no right to share, including photos of people who asked not to be photographed.
- The organiser can hide any photo or fact; we can remove content that breaks these terms.
6.Payment
- Creating an event and trying it out is free up to five activated codes.
- Paid tiers by number of guests, upgrades and interactive modules are one-time in-app purchases made by the organiser through the App Store or Google Play, under the terms of those stores. Prices on the website are in USD; the final price in your currency is shown by the store.
- A purchase is attached to one event and cannot be moved to another.
- Refunds are handled by Apple or Google under their rules. If a purchase is refunded before the event starts, the event goes back to the free limit; after the start, access is not withdrawn.
7.Storage
Photos, facts and participant data are deleted 90 days after the event ends. The gallery is not an archive: download it as a ZIP before then.
8.Availability
We work to keep the Service running but do not guarantee that it is uninterrupted. Push notifications depend on Apple, Google and the device settings and may arrive late or not at all; important information is also shown in the app. Do not rely on the Service as the only way to give guests safety information.
9.Liability
The Service is provided “as is”. To the extent permitted by law, we are not liable for indirect losses, and our total liability is limited to [LIMIT]. Nothing in these terms limits liability that cannot be limited by law. [TO BE CONFIRMED BY COUNSEL.]
10.Ending the use
The organiser can delete an event (as a draft or once archived) and the account. We may suspend access for breaches of these terms, telling the organiser why where the law allows.
11.Changes and governing law
We publish changes to these terms on this page with a new date and tell organisers about significant ones by email. These terms are governed by [GOVERNING LAW]; disputes go to [JURISDICTION].
